Please read these Terms and Conditions ("Terms") carefully before using the Kaltcha website and its associated tools (the "Service") operated by Kaltcha OÜ ("us", "we", or "our").

1. Acceptance of Terms

By accessing and using our Service, you accept and agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Use of the Service

The Service provides questionnaires, AI-generated analysis, and other tools (such as the 5DT Assessment and the Team Diagnostics Check) to help users understand their professional style and improve team dynamics. The results and descriptions are for informational and developmental purposes only.

The Service is intended for personal development, team-building insights, and strategic analysis. It is not designed or intended to be used as the sole basis for formal employment decisions, including but not limited to hiring, promotion, performance reviews, or termination.

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Kaltcha OÜ and its licensors. The framework, including all questionnaires, the definitions of the Five Dimensions, the Kaltcha Blueprint, and the underlying scoring logic, are the intellectual property of Kaltcha OÜ. The terms "Kaltcha" and "Five Dimensional Teams" are trademarks of Kaltcha OÜ.

The personalized profile summaries and action plans are generated by an AI model operated by a third party (Google). However, the generation of this content is guided by proprietary and confidential prompts developed by Kaltcha OÜ. While you are granted a license to use your results, this does not grant you any rights to the underlying prompting methodology.

4. License to Use Results

We grant you a limited, personal, non-commercial, non-transferable license to use, share, and reproduce the profile summaries and action plans generated for you by the Service. You may share them with your team, use them for personal development, or discuss them freely. This license does not permit you to use your results for any commercial purpose, such as reselling the content or including it in a paid service, without our express written consent.

5. Limitation of Liability

In no event shall Kaltcha OÜ, nor its directors or employees, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect.
